Where no binding death benefit nomination exists\, superannuation trustees exercise their discretion\, which commonly results in death benefits being paid to individuals asserting financial dependency that may not be legally or factually supported. \nThis seminar examines the emerging role of executors in challenging superannuation trustee decisions\, including the evidentiary basis for dependency claims\, trustee obligations\, and available review and dispute pathways.
