Topic: Further strategies in Estate Litigation: Testamentary Trusts
Solicitors are often called upon to advise clients as to their rights arising from wills containing testamentary trusts, either in the aftermath of a testator’s death, or following years of the administration of such trusts. There is a perception that unless testamentary trusts are successfully challenged as part of an attack on a will containing them there is little prospect of a discretionary beneficiary extracting any concrete value, even where the need to do so is pressing. This paper seeks to canvas some means by which such trusts might be challenged in the aftermath of a testator’s passing, and to suggest that although usually challenging, attacks on the administration of discretionary trusts should not be discounted.
