Topic: Till Death Do Us Part(nership) – Partnerships, Succession Planning and Estate Administration

Historically, partnerships were often used for small to medium sized business ventures. Over time, business ventures and tax planning have become more sophisticated, the risk of joint liability too risky, and professional rules relating to accountants, lawyers and other professionals have been relaxed, so business ventures often operate through companies and trusts.  However, estate practitioners may still need to deal with lingering partnerships in estate administration, and need to understand the principles of partnership law and in particular what happens on the dissolution of the partnership.
